Poteau Family Fitness General Liability Waiver

Please read this waiver carefully before participating in any activities at Poteau Family Fitness. This document limits the liability of Poteau Family Fitness and its owners, employees, and agents. By signing this waiver, you acknowledge and accept the risks associated with fitness activities and agree to release Poteau Family Fitness from any claims or damages.

1. Assumption of Risk: I understand and acknowledge that participating in fitness activities at Poteau Family Fitness involves certain risks, including but not limited to, the risk of injury, illness, or property damage. I voluntarily assume all such risks and any associated consequences.
2. Physical Condition: I hereby confirm that I am in good physical condition and have no medical conditions or physical limitations that would prevent me from safely participating in fitness activities at Poteau Family Fitness. I understand that it is my responsibility to consult with a healthcare professional before starting any exercise program.
3. Release of Liability: In consideration of being permitted to use the facilities and equipment at Poteau Family Fitness, I, on behalf of myself, my heirs, and my personal representatives, hereby release, waive, discharge, indemnify, and hold harmless Poteau Family Fitness, its owners, employees, and agents from any and all claims, demands, causes of action, lawsuits, damages, or liabilities, whether known or unknown, arising out of or related to my participation in fitness activities at Poteau Family Fitness .
4. Covenant Not to Sue: I agree not to sue Poteau Family Fitness, its owners, employees, and agents for any claims, demands, causes of action, lawsuits, damages, or liabilities arising out of or related to my participation in fitness activities at Poteau Family Fitness.
5. Personal Property: I understand and acknowledge that Poteau Family Fitness is not responsible for any loss, theft, or damage to personal property that may occur while I am on the premises.
6. Photographic Release: I grant Poteau Family Fitness permission to use photographs or videos taken during my participation in fitness activities for promotional purposes, including but not limited to, website content, social media, and advertising materials.
7. Severability: If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. I have read this General Liability Waiver, fully understand its contents, and voluntarily agree to its terms.

Terms and Conditions Agreement This Terms and Conditions Agreement ("Agreement") is entered into between Poteau Family Fitness ("Fitness Center") and the individual ("Member") utilizing the facilities and services provided by the Fitness Center. By becoming a member, the Member agrees to abide by the following terms and conditions:

1. Membership and Facility Access: a. The Member must be at least 18 years of age or have written consent from a legal guardian. b. Membership is non-transferable and may not be shared with others. c. The Member shall have 24-hour access to the Fitness Center's facilities, subject to any temporary closures or limitations for maintenance or safety reasons.
2. Care of Facility and Equipment: a. The Member agrees to treat all Fitness Center facilities, equipment, and amenities with care and respect. b. Any damage caused to the Fitness Center's property due to the Member's negligence will be the Member's responsibility, and appropriate repair or replacement costs will be charged. c. Members must immediately report any equipment malfunctions, damages, or safety concerns to Fitness Center staff.
3. Health and Safety: a. The Member acknowledges and understands that the use of Fitness Center facilities and equipment carries inherent risks. The Member agrees to use the facilities and equipment at their own risk and assumes full responsibility for any injuries or damages that may occur. b. Members are encouraged to consult with a medical professional before starting any exercise program or using Fitness Center facilities. c. Members must follow all posted safety guidelines, instructions, and warnings provided by the Fitness Center staff.
4. Respect for Other Members: a. The Member agrees to treat all Fitness Center staff and fellow members with respect, courtesy, and consideration. b. Harassment, discrimination, verbal or physical abuse, or any behavior that creates an intimidating or hostile environment is strictly prohibited. c. The Fitness Center reserves the right to take appropriate action, including termination of membership, in response to any violations of this section.
5. Children's Area: a. Children must remain in the designated children's area at all times and be supervised by a responsible adult. b. The Fitness Center is not responsible for any injuries or incidents involving children in the facility. c. Children are not allowed to use Fitness Center equipment or facilities unless specifically designated for their use.
6. Membership Fees and Payment: a. The Member agrees to pay the membership fees as outlined in the membership agreement. b. Membership fees are non-refundable, and the Fitness Center does not provide refunds for unused portions of a membership term. c. The Fitness Center reserves the right to modify membership fees with a notice provided to the Member in advance.
7. Termination and Cancellation: a. Either party may terminate this Agreement by providing written notice to the other party. b. The Member may cancel their membership by providing a 30-day written notice to the Fitness Center. c. Any fees due within the 30 days following cancellation notice, including past due balances must be paid before cancellation is submitted. d. The Fitness Center reserves the right to terminate a Member's access to the facility and services for violation of this Agreement or any other policies or rules established by the Fitness Center.
8. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the state of Oklahoma. Any legal actions arising out of or related to this Agreement shall be filed exclusively in the courts located within the state of Oklahoma. By signing below or using the Fitness Center's facilities
